Young UKELA is delighted
to announce the latest in our series of 'The Basics' Seminars, which aim to explain the fundamentals of environmental law to those in the early(ish) years of practice, in an inclusive format that encourages the presentations to give way to friendly Q&A, debate and networking.
The seminar will provide an introduction to this
important topic, explaining the background to and application of the
Environmental Information Regulations 2004 from both a practical and legal
perspective. The session will be led by two experienced practitioners in
this area: Gerry Facenna QC of Monckton Chambers and Kate Harrison of Harrison
Grant solicitors. The discussion will cover the following topics:

the meaning of environmental
information
-
the public interest balancing test
-
public authorities to whom the
Regulations apply
-
how the access regime operates in
practice, including the appeal procedure
-
the relationship with Freedom of
Information, the Aarhus Convention and the possible impact of Brexit
Like other Young UKELA seminars, the event is
informal in nature, intended to encourage participation and learning.
Gerry Facenna QC is a barrister at Monckton
Chambers, who is ranked by the legal directories as a leading silk in
Administrative & Public law, Data Protection, Competition, Environment, EU
law and Telecoms.
Kate Harrison is a founding partner of Harrison
Grant solicitors; she also lectures and has previously worked for NGOs.
She is ranked in Tier 1 by the Chamber's Guide to the Legal Profession for
claimant work.
Kate and Gerry acted for the applicant in the
recent case of DBEIS v Information Commissioner and Henney [2017] EWCA
Civ 844.
The seminar will be chaired by Ned Westaway, UKELA
trustee (and barrister at Francis Taylor Building).
